Welcome to MyWins. These Terms of Service ("Terms") govern your use of the MyWins mobile application and website (the "Service"), operated by MyWins, part of the ThrivingFam family ("we," "our," or "us").
By downloading, installing, or using MyWins, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account and use the Service. MyWins is designed for use by parents and caregivers to manage household routines. The app is not intended for direct use by children.
2. Account Registration
To use most features of the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
You may sign up using an email and password or through Google Single Sign-On. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Use of the Service
Permitted Use
MyWins grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial household management purposes.
Prohibited Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts, bots, or scraping tools to access the Service
- Upload malicious content, viruses, or harmful code
- Impersonate another person or entity
- Use the Service in any way that could damage, disable, or impair its operation
4. Subscriptions and Payments
Free Trial
New users may be eligible for a free trial period. At the end of the trial, your access to premium features will be limited unless you subscribe.
Paid Subscriptions
Premium features require a paid subscription. By subscribing, you agree to:
- Pay the subscription fee at the frequency you selected (monthly or annually)
- Automatic renewal of your subscription unless you cancel before the renewal date
- Payment processing by our third-party payment provider, Stripe, subject to their terms of service
Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refunds will be issued for partial billing periods.
5. Collaborators
You may invite other adults to collaborate within your household. By inviting a collaborator, you:
- Grant them access to shared chore data and child profiles within your household
- Acknowledge that you have obtained their consent to share their email address with us
- Remain responsible for the content and data within your household account
6. Your Content
You retain ownership of all content you create within the Service (chore names, routine configurations, notes, etc.). By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.
We do not claim ownership of your content and will not use it for advertising or share it with third parties, except as described in our Privacy Policy.
7. Intellectual Property
The MyWins name, logo, design, and all original content on the Service (excluding user-generated content) are the intellectual property of MyWins / ThrivingFam and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from our intellectual property without written permission.
8. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- The results obtained from the Service will be accurate or reliable
- Any defects in the Service will be corrected
MyWins is a household management tool, not a substitute for professional parenting advice, child development guidance, or medical recommendations.
9. Limitation of Liability
To the maximum extent permitted by law, MyWins and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or personal injury.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless MyWins and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of paid features.
12. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
For material changes, we will notify you via email or an in-app notification at least 30 days before the changes take effect.
13. Termination
We may terminate or suspend your account at our discretion if you violate these Terms. You may terminate your account at any time by contacting us at hello@mywins.family.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) shall remain in effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
